Throughout these Terms and Conditions, EMPOWERING GROWTH, S.L. shall be referred to as “EIHE”, “we”, “our”, or “the Company.”

2. PURPOSE
These Terms and Conditions govern the purchase and delivery of all educational programmes, online courses, professional development activities, events, digital learning resources and other services made available through the EIHE website.
By completing the purchase process, you acknowledge that you have read, understood and agree to be legally bound by these Terms and Conditions.
2. OBJETO
Las presentes Condiciones regulan la contratación de los servicios ofrecidos a través de la plataforma, incluyendo programas formativos, cursos online, eventos y otros servicios relacionados.
La contratación implica la aceptación expresa de estas condiciones.
3. ELIGIBILITY
Our services may be purchased by:
- Individuals aged 18 years or over; and
- Healthcare professionals and other individuals seeking professional or continuing education.
By placing an order, you confirm that you have the legal capacity to enter into a binding contract.
3. USUARIOS
Podrán contratar los servicios:
- Personas físicas mayores de 18 años
- Profesionales del ámbito sanitario u otros perfiles formativos
El usuario declara que dispone de capacidad legal para contratar.
4. ENROLMENT PROCESS
The enrolment process consists of the following steps:
- Selection of the programme or service.
- Submission of the required personal information.
- Review and confirmation of the order.
- Acceptance of these Terms and Conditions.
- Completion of payment.
Once your enrolment has been successfully completed, EIHE will send confirmation electronically to the email address provided during registration.
EIHE reserves the right to correct any typographical, technical or administrative errors prior to confirming an order.
4. PROCESO DE CONTRATACIÓN
El proceso de contratación incluirá:
- Selección del servicio o programa
- Introducción de datos personales
- Confirmación del pedido
- Aceptación de las presentes condiciones
- Realización del pago
El usuario recibirá confirmación de la contratación por vía electrónica.
El Titular podrá corregir errores técnicos o tipográficos antes de la confirmación.
5. PRICING AND PAYMENT
Prices displayed on the Website may be presented in different currencies depending on your geographical location or the preferences selected during your browsing session.
All payments, however, will be processed in the currency specified at the time of purchase.
Your bank or payment provider may apply exchange rates, currency conversion fees or other charges, for which EIHE accepts no responsibility.
Unless otherwise stated, all published prices include any applicable taxes required under the relevant legislation.
Where additional taxes, duties or charges apply in the user’s jurisdiction, these will be clearly communicated before the purchase is completed.
Payments may be made using any payment methods available on the Website, including:
- Debit or credit card
- Bank transfer
- Any other payment method made available by EIHE
Access to educational services may be conditional upon successful payment authorisation.
EIHE reserves the right to suspend or refuse access where payment has been declined, cancelled, reversed or is otherwise unsuccessful.
5. PRECIO Y FORMA DE PAGO
Los precios de los servicios ofrecidos a través de la plataforma podrán mostrarse en distintas monedas en función de la ubicación geográfica del usuario o de la configuración seleccionada.
No obstante, todos los pagos se procesarán en la moneda indicada en el momento de la contratación, pudiendo aplicarse tipos de cambio, comisiones bancarias u otros costes adicionales derivados de la entidad financiera del usuario, sobre los cuales el Titular no tiene control ni responsabilidad.
Salvo indicación expresa en contrario, los precios incluirán los impuestos aplicables conforme a la normativa vigente. En caso de que proceda la aplicación de impuestos adicionales según la jurisdicción del usuario, estos serán debidamente informados antes de la finalización del proceso de compra.
El pago podrá realizarse mediante los siguientes métodos:
- Tarjeta bancaria
- Transferencia bancaria
- Otros métodos de pago habilitados en la plataforma en cada momento
El acceso a los servicios contratados podrá quedar condicionado a la correcta confirmación del pago. En caso de rechazo, cancelación o incidencia en el pago, el Titular se reserva el derecho a suspender o cancelar el acceso al servicio hasta que la situación sea regularizada.
6. DELIVERY OF SERVICES
Educational services may include online courses, live teaching sessions, webinars, virtual learning environments, downloadable educational resources or any other services described at the time of purchase.
Upon successful enrolment, learners will receive the credentials required to access the relevant learning platform.
Unless otherwise stated:
- Access is personal and non-transferable;
- Login credentials must not be shared with any third party; and
- Access will remain valid only for the period specified in the relevant programme description.
6. PRESTACIÓN DEL SERVICIO
El servicio consistirá en el acceso a contenidos formativos, plataformas digitales, sesiones en directo o cualquier otro servicio contratado.
El usuario recibirá las credenciales de acceso necesarias.
El acceso será:
- Personal e intransferible
- Limitado al periodo contratado
7. RIGHT OF WITHDRAWAL
Where applicable, consumers have the right to withdraw from a distance contract within fourteen (14) calendar days in accordance with Spanish Royal Legislative Decree 1/2007.
However, this statutory right may no longer apply where:
- The educational service has commenced during the withdrawal period;
- The learner has expressly requested immediate access to the course or digital content; and
- The learner has expressly acknowledged that, by doing so, they waive their statutory right of withdrawal.
Where these conditions have been met, no refund shall be due following commencement of the educational service.
7. DERECHO DE DESISTIMIENTO
De conformidad con el Real Decreto Legislativo 1/2007:
El usuario dispone de un plazo de 14 días naturales para desistir del contrato.
No obstante, este derecho podrá quedar excluido cuando:
- El servicio haya comenzado
- El usuario haya otorgado consentimiento expreso para su inicio
- Y haya reconocido la pérdida de su derecho de desistimiento
8. CANCELLATIONS AND CHANGES
Unless expressly stated otherwise in the programme information:
- Cancellations will not be accepted once access to the educational service has commenced; and
- Requests to modify enrolments are subject to availability and EIHE’s discretion.
EIHE may, at its sole discretion, consider exceptional requests on a case-by-case basis.
8. CANCELACIONES Y MODIFICACIONES
Salvo que se indique lo contrario:
- No se admitirán cancelaciones una vez iniciado el servicio
- Las modificaciones estarán sujetas a disponibilidad
En casos excepcionales, el Titular podrá valorar solicitudes individuales.
9. USER RESPONSIBILITIES
Users agree to:
- Provide accurate, complete and up-to-date information;
- Maintain the confidentiality of their login credentials;
- Use the Website and educational services lawfully and responsibly.
Users must not:
- Copy, reproduce, distribute or commercially exploit any educational materials;
- Share access credentials;
- Use the Website for unlawful, fraudulent or harmful purposes; or
- Interfere with the operation or security of EIHE’s digital platforms.
9. OBLIGACIONES DEL USUARIO

Queda prohibido:
- Reproducir o distribuir contenidos
- Utilizar la plataforma con fines ilícitos
10. INTELLECTUAL PROPERTY
All educational materials, publications, presentations, videos, graphics, assessments, software, trademarks and other content made available through EIHE remain the intellectual property of EIHE or its licensors.
Except where expressly authorised in writing, users may not:
- Reproduce
- Distribute
- Publish
- Modify
- Translate
- Record
- Commercially exploit
- Otherwise make available
Any part of EIHE’s educational content. Unauthorised use may result in suspension of access and legal action.
10. PROPIEDAD INTELECTUAL
Todos los contenidos son propiedad del Titular o cuentan con licencia.
Queda prohibida su:
- Reproducción
- Distribución
- Comunicación pública
Sin autorización expresa.
11. SPECIAL PROVISIONS FOR HEALTHCARE PROFESSIONALS
Many of EIHE’s educational programmes are intended for qualified healthcare professionals.
Accordingly, learners acknowledge and agree to the following:
Professional Use of Educational Content
All educational materials are provided exclusively for educational and professional development purposes.
They do not constitute medical advice, clinical recommendations, treatment protocols or professional consultation.
Learners remain solely responsible for exercising their own independent clinical judgement when applying any knowledge or techniques acquired through EIHE programmes.
Clinical Responsibility
EIHE accepts no responsibility or liability for:
- Clinical decisions made by learners;
- Patient outcomes;
- Treatment choices;
- Diagnostic decisions; or
- The application of any techniques, procedures or recommendations discussed during educational activities.
Healthcare professionals remain individually responsible for practising within the scope of their professional licence, complying with applicable legislation, professional standards and the recognised principles of good medical practice (lex artis).
Patient Confidentiality
Learners must not upload, disclose or share identifiable patient information unless they are legally authorised to do so and all applicable data protection requirements have been satisfied.
Users are solely responsible for ensuring compliance with all applicable privacy, confidentiality and healthcare regulations.
11. CLÁUSULA ESPECÍFICA PARA PROFESIONALES SANITARIOS
En caso de que el usuario sea un profesional sanitario:

Los contenidos tienen carácter formativo y no sustituyen el criterio clínico del profesional.
El usuario es el único responsable de la aplicación de los conocimientos adquiridos.
Responsabilidad clínica
El Titular no será responsable de:
- Decisiones clínicas
- Resultados derivados de la aplicación de técnicas
El usuario deberá actuar conforme a la normativa vigente y la lex artis médica.
Protección de datos de pacientes
El usuario se compromete a:
- No compartir datos personales de pacientes sin base legal
- Cumplir la normativa de protección de datos
12. LIMITATION OF LIABILITY
EIHE makes reasonable efforts to ensure that its educational services remain available and function correctly.
However, EIHE does not warrant that services will be uninterrupted, error-free or continuously available.
To the fullest extent permitted by law, EIHE shall not be liable for losses arising from:
- Improper use of the Website or learning platform;
- Technical failures beyond EIHE’s reasonable control;
- Internet outages;
- Third-party service interruptions; or
- Force majeure events.
Nothing in these Terms excludes or limits liability where such exclusion would be unlawful.
12. EXCLUSIÓN DE RESPONSABILIDAD
El Titular no garantiza:
- La disponibilidad continua del servicio
- La ausencia de errores técnicos
No será responsable de daños derivados de:
- Uso indebido
- Fallos técnicos externos
13. DATA PROTECTION
The processing of personal data is governed by EIHE’s Privacy Policy, which forms an integral part of these Terms and Conditions.

14. CHANGES TO THESE TERMS
EIHE reserves the right to amend these Terms and Conditions at any time.
Any material changes will be published on the Website and, where appropriate, notified to registered users before taking effect.
Continued use of EIHE’s services after such changes become effective constitutes acceptance of the revised Terms.
14. MODIFICACIÓN DE LAS CONDICIONES
El Titular podrá modificar las presentes condiciones.

15. GOVERNING LAW AND JURISDICTION
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of Spain.
Any dispute arising from these Terms shall be subject to the jurisdiction of the competent courts in accordance with applicable consumer protection legislation.
Where mandatory consumer protection rules do not apply, the parties agree to submit to the exclusive jurisdiction of the Courts of Seville, Spain.
